Breathalysers in pubs and clubs - a cause for concern?

We have previously commented on the recent trend for the use of breathalysers on persons seeking entry to licensed premises, particularly in the evening; see our article 'Breathalysers in pubs and clubs - a cause for concern?

News of their planned introduction in Newquay and Truro where some 20+ premises have apparently agreed to the use of breathalysers, with two JDW outlets notable exceptions, has encouraged to repeat our caution over their introduction and use.

For all the reasons previously expressed it is our considered view that operators should proceed with considerable care (and with the benefit of legal advice if desired) in contemplating the introduction or imposition of breathalysers at their premises.

Law correct at the date of publication.
